Terms of Service for AI Journal

1. Acceptance of Terms

By downloading, installing, or using the AI Journal mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

AI Journal is a personal journaling application that allows users to:

  • Create and manage journal entries with text, photos, videos, audio, and drawings
  • Organize entries with tags, categories, and calendar views
  • Track habits and personal goals
  • Access AI-powered insights and summaries (Premium feature)
  • Backup and sync data across devices (Premium feature)
  • Export journals as PDF documents

3. User Accounts and Registration

Account Creation

  • You may use the App without creating an account (local storage only)
  • Cloud backup and sync features require account creation
  • You are responsible for maintaining the confidentiality of your account credentials

Account Security

  • You must provide accurate and complete information
  • You are responsible for all activities under your account
  • Notify us immediately of any unauthorized access

4. Subscription and Payments

Free Version

  • The App offers a free version with basic features and advertisements
  • Free features may be limited compared to Premium subscription

Premium Subscription

  • Premium subscriptions are available through Apple's In-App Purchase system
  • Subscription prices are displayed in the App and may vary by region
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
  • Payment is charged to your Apple ID account at confirmation of purchase
  • Manage or cancel subscriptions through your Apple ID account settings

Refunds

  • Refund requests are subject to Apple's refund policies
  • Contact Apple Support for refund inquiries
  • We do not have access to or control over Apple's refund process

5. User Content

Your Content

  • You retain all rights to the content you create in the App (journal entries, photos, etc.)
  • You are solely responsible for your content and its legality
  • We do not claim ownership of your journal entries or personal data

Content Storage

  • Local content is stored on your device
  • Cloud-synced content is stored securely on our servers (if you enable cloud backup)
  • You can delete your content at any time

Prohibited Content

You agree not to create, upload, or share content that:

  • Is illegal, harmful, threatening, abusive, or harassing
  • Infringes on intellectual property rights
  • Contains viruses or malicious code
  • Violates any applicable laws or regulations

6. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the App in any way that violates applicable laws or regulations
  • Attempt to gain unauthorized access to the App or its systems
  • Reverse engineer, decompile, or disassemble the App
  • Remove or modify any copyright, trademark, or proprietary notices
  • Use the App to transmit spam or unsolicited messages
  • Interfere with or disrupt the App's functionality
  • Use automated systems to access the App without permission

7. Intellectual Property Rights

Our Rights

  • The App and its original content, features, and functionality are owned by us
  • The App is protected by copyright, trademark, and other intellectual property laws
  • Our trademarks and trade dress may not be used without written permission

License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on your personal devices
  • Use the App for personal, non-commercial purposes
  • Access features according to your subscription level

8. Third-Party Services

The App integrates with third-party services including:

  • Firebase (Google) for analytics, crash reporting, and cloud storage
  • Google Mobile Ads for advertising
  • Apple services for in-app purchases Your use of these services is subject to their respective terms and privacy policies.

9. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

10. Disclaimers and Limitations of Liability

No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the App will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy or reliability of content

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of data, profits, or business opportunities
  • Damages resulting from your use or inability to use the App
  • Damages exceeding the amount you paid for the App in the past 12 months

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your content or data

12. Data Backup and Loss

Your Responsibility

  • You are responsible for backing up your journal entries
  • We recommend enabling cloud backup or regularly exporting your data
  • We are not liable for any data loss, corruption, or deletion

Service Availability

  • We strive to maintain high availability but do not guarantee uninterrupted service
  • We may perform maintenance that temporarily limits access
  • We will provide notice of planned maintenance when possible

13. Termination

By You

  • You may stop using the App at any time
  • You may delete your account through the App settings
  • Deleting the App does not automatically cancel subscriptions

By Us

We may suspend or terminate your access if:

  • You violate these Terms
  • You engage in fraudulent or illegal activities
  • Required by law or legal process
  • We discontinue the App

Effect of Termination

  • Your right to use the App immediately ceases
  • We may delete your cloud-stored data after a reasonable period
  • Provisions that should survive termination will remain in effect

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting updated Terms in the App
  • Updating the "Last Updated" date
  • Sending you a notification (for significant changes) Your continued use after changes constitutes acceptance of the new Terms.

15. Governing Law and Dispute Resolution

Governing Law

These Terms are governed by the laws of [YOUR JURISDICTION], without regard to conflict of law principles.

Dispute Resolution

  • Any disputes shall first be attempted to be resolved through good faith negotiation
  • If negotiation fails, disputes may be resolved through binding arbitration

These Terms, along with our Privacy Policy, constitute the entire agreement between you and us.

Severability

If any provision is found unenforceable, the remaining provisions will remain in effect.

No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

Assignment

You may not assign these Terms without our consent. We may assign these Terms without restriction.

Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.

18. Apple-Specific Terms

Acknowledgment

You acknowledge that:

  • Apple is not responsible for addressing any claims related to the App

Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

App Store Terms

Your use of the App must comply with the Apple App Store Terms of Service.

By using AI Journal, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
