Terms and Conditions

Welcome to Product Catalog (com.alkashier.prodcatalog), operated by alkashier ("Company", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Product Catalog mobile application, its associated web storefronts, services, and features (collectively, the "Service").

By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Service.

1. User Accounts and Merchant Backend

To utilize merchant features, you must authenticate using your email address and password. Passwords are used solely for authentication against our Laravel POS backend and are never stored in plain text by us. Upon successful login, a bearer session token is stored on your device to maintain your session.

You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You agree to notify us immediately at support@alkashier.com of any unauthorized access or use of your account.

2. Product Catalog Content & Buyer Orders

2.1 Merchant Catalog Data

As a merchant, you may create and publish a product catalog containing product names, prices, descriptions, categories, and photos ("Catalog Data"). By publishing Catalog Data, you grant alkashier a worldwide, non-exclusive, royalty-free license to host, display, and transmit your Catalog Data on public web storefronts connected to the Service.

2.2 Public Web Storefront & Buyer Data

The Service enables buyers to view public product catalogs and submit cash-on-delivery (COD) orders. Buyers submitting orders must provide their name, phone number, delivery address, and order contents. Buyer data is retained for a limited operational window to facilitate order fulfillment and may be requested for deletion at any time in accordance with Section 8.

3. Subscriptions ("Catalog Pro")

The free tier of the Service permits publishing up to ten (10) products. To unlock unlimited published products, merchants may subscribe to "Catalog Pro", an auto-renewing subscription tier offered on a monthly or yearly basis.

• In-App Purchases Only: Subscriptions are sold and processed exclusively through Apple StoreKit (for iOS) or Google Play Billing (for Android). No other purchase mechanism exists or will be honored.
• Billing and Renewal: Subscription fees will be charged to your Apple ID or Google Play account upon confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours prior to the end of the current billing period.
• Management & Cancellation: You can manage or cancel your subscription at any time through your device's account settings (Apple App Store Account Settings or Google Play Subscriptions). Refunds are subject to the policies of Apple and Google.

4. Third-Party Advertising & Data Processing

The Service is offered as an ad-supported application provided free of charge (subject to paid premium subscription tiers). Third-party advertisements are served by Google AdMob and its partners.

• Ad Serving & Consent: Banner advertisements on the Home screen utilize Google AdMob, which collects Android Advertising ID and IP-derived coarse location. In applicable regions (such as the European Economic Area and the United Kingdom), personalized advertising is gated by the Google User Messaging Platform (UMP) consent mechanism. On iOS devices, the Apple App Tracking Transparency (ATT) prompt will be displayed prior to issuing ad requests.
• Ad Content Disclaimer: We are not responsible for the content, accuracy, products, services, or privacy practices of third-party advertisers. Any dealings or transactions between you and third-party advertisers found through the Service are solely between you and the advertiser.
• Analytics and SDKs: We utilize SmartLinks (live.smartlinks) for attribution, analytics, link redirection, and feedback, processing `app_user_id` and `attribution_id`. SmartLinks links integration with Firebase Core, Firebase Messaging, and Firebase Analytics for overall application performance and messaging services.

5. Intellectual Property Rights

Except for user-submitted Catalog Data, all right, title, and interest in and to the Service—including software code, branding, trademarks, logos, visual designs, and interface features—are and will remain the exclusive property of alkashier and its licensors. You may not copy, modify, distribute, sell, reverse engineer, or lease any part of our Service without our express written permission.

6. Prohibited Activities

You agree not to engage in any of the following prohibited activities while using the Service:

• Publishing illegal, fraudulent, deceptive, defamatory, obscene, or infringing product listings or images;
• Submitting false, misleading, or abusive cash-on-delivery orders through public web storefronts;
• Using automated means (such as bots, scrapers, or crawlers) to access or harvest data from the Service without permission;
• Attempting to interfere with, compromise, or disrupt the integrity or security of our server infrastructure, Laravel POS backend, or APIs;
• Bypassing or attempting to bypass subscription restrictions or purchase mechanisms.

7. Disclaimer of Warranties ("AS IS")

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR AVAILABILITY. ALKASHIER DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ALKASHIER, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (III) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR DATA.

9. Data Deletion and Account Termination

Users and buyers may request deletion of their account or order data at any time through the in-app Settings menu or via our web form. We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that violates these Terms or is harmful to other users, third parties, or us.

10. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which alkashier is established, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the competent courts of alkashier's operating jurisdiction.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be published within the application and on our website with a revised "Last Updated" date. Continued use of the Service after any modifications constitutes acceptance of the new Terms.
