Terms of Service for Crypto Pulse

1. Agreement to Terms

Welcome to Crypto Pulse. These Terms of Service ("Terms") constitute a legally binding agreement between you and Alkashier LTD ("we," "us," or "our") regarding your use of the Crypto Pulse mobile application (the "App").

By downloading, installing, or using Crypto Pulse, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Eligibility

2.1 Age Requirement

2.3 Legal Capacity

You represent that you have the legal capacity to enter into these Terms and that you are not prohibited by law from using the App.

3. License and Access

3.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your mobile device
• Use the App for personal, non-commercial purposes

3.2 Restrictions

You agree NOT to:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any portion of the App
• Use the App to transmit viruses or malicious code
• Use automated systems (bots, scrapers) to access the App
• Sell, rent, lease, or sublicense the App
• Use the App to violate any applicable laws or regulations

3.3 Updates

We may provide updates, patches, or new versions of the App. You agree to install such updates to continue using the App. Some updates may be mandatory for continued operation.

4. App Features and Services

4.1 Core Features (Free Tier)

Crypto Pulse provides:

• Real-time cryptocurrency price tracking (with 15-minute delay for free users)
• Access to 5 hot coins (BTC, ETH, BNB, SOL, XRP)
• Basic price charts
• 1 home screen widget
• Market depth viewer (basic)

4.2 Premium Features (Paid Subscriptions)

Premium and Pro tiers unlock:

• Real-time price updates (no delay)
• Access to 1000+ cryptocurrencies
• Advanced chart timeframes and indicators
• Portfolio analytics
• Multiple home widgets
• Binance account integration
• Price alerts
• Data export (CSV/PDF)
• Tax reports (Pro only)

4.3 Binance Integration (Optional)

If you choose to connect your Binance account:

• You must provide valid Binance API credentials
• We require read-only API permissions only
• We never request trading or withdrawal permissions
• You are responsible for securing your API credentials
• You can disconnect at any time
• We are not affiliated with or endorsed by Binance

4.4 No Financial Advice

IMPORTANT: Crypto Pulse is a cryptocurrency tracking and portfolio management tool. We do NOT provide:

• Investment advice
• Trading recommendations
• Financial planning services
• Tax advice (data export features are tools only, consult a tax professional)

All information displayed is for informational purposes only. You are solely responsible for your investment decisions.

5. Subscriptions and Payments

5.1 Subscription Plans

Crypto Pulse offers three tiers:

• Free: No cost, limited features
• Premium: Monthly or yearly subscription
• Pro: Monthly or yearly subscription

5.2 Pricing and Payment

• Subscription prices are displayed in the App and set by Google Play Store or Apple App Store
• Prices may vary by region and currency
• Payment is processed through Google Play Billing (Android) or Apple App Store (iOS)
• We do not collect or store payment information directly

5.3 Auto-Renewal

• Subscriptions automatically renew unless canceled
• You will be charged at the start of each billing period
• Cancel anytime through your Google Play or App Store account settings
• Cancellation takes effect at the end of the current billing period

5.4 Free Trial

• New users may be eligible for a 7-day free trial of Premium or Pro plans
• You will be charged when the trial period ends unless you cancel
• Cancel during the trial period to avoid charges
• One free trial per user

5.5 Refunds

• Refund policies are governed by Google Play Store and Apple App Store
• We do not control refund decisions
• For refund requests, contact Google Play or App Store support
• In exceptional cases, contact us at info@alkashier.com

5.6 Price Changes

• We reserve the right to change subscription prices
• Price changes will not affect active subscriptions until renewal
• You will be notified of price changes in advance
• Continued use after price change constitutes acceptance

6. User Responsibilities

6.1 Account Security

You are responsible for:

• Protecting your device security
• Securing your Binance API credentials (if used)
• Maintaining the confidentiality of your data
• Any activity that occurs through your use of the App

6.2 Accurate Information

You agree to:

• Provide accurate information when using the App
• Update information as needed
• Not impersonate others or misrepresent your identity

6.3 Compliance with Laws

You agree to:

• Comply with all applicable laws and regulations
• Not use the App for illegal activities
• Comply with cryptocurrency regulations in your jurisdiction
• Pay any applicable taxes on cryptocurrency transactions

6.4 Prohibited Uses

You may NOT use the App to:

• Engage in money laundering or terrorist financing
• Violate securities laws or regulations
• Manipulate cryptocurrency markets
• Engage in fraudulent activities
• Harass, threaten, or harm others
• Spread malware or viruses

7. Third-Party Services

7.1 External Links and Services

The App integrates with and may link to third-party services:

• Binance API (cryptocurrency data and account integration)
• Google AdMob (advertising)
• Firebase (analytics and crash reporting)
• Google Play Billing / Apple App Store (payments)

7.2 Third-Party Responsibility

• We are not responsible for third-party services, content, or policies
• Your use of third-party services is subject to their terms and policies
• We do not endorse or guarantee third-party services
• We are not liable for any damages arising from third-party services

7.3 Advertising

• The App displays advertisements via Google AdMob
• We do not control ad content
• Clicking on ads is at your own risk
• We are not responsible for advertiser claims or offers

8. Data and Privacy

8.1 Privacy Policy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at PRIVACY_POLICY.md.

8.2 Data Storage

• All user data is stored locally on your device only
• We do not store user data on our servers
• Uninstalling the App deletes all local data
• We cannot recover data after uninstallation

9. Intellectual Property

9.1 Our Rights

All intellectual property rights in the App, including but not limited to:

9.2 Copyright

The App is protected by copyright laws and international treaties. Unauthorized reproduction or distribution is prohibited and may result in civil and criminal penalties.

9.3 Trademarks

"Crypto Pulse" and related marks are trademarks of Alkashier LTD. You may not use our trademarks without prior written permission.

9.4 User Data

You retain all rights to your data stored in the App. By using the App, you grant us a license to process your data solely to provide App functionality.

10. Disclaimers and Limitations

10.1 No Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability: The App may not meet your requirements
• Fitness for Purpose: The App may not be suitable for your intended use
• Accuracy: Cryptocurrency prices and data may be inaccurate or delayed
• Availability: The App may experience downtime or interruptions
• Security: We cannot guarantee absolute security

10.2 Cryptocurrency Risks

IMPORTANT: Cryptocurrency markets are highly volatile and risky. You acknowledge:

• Cryptocurrency prices can change rapidly
• You may lose money on cryptocurrency investments
• Past performance does not indicate future results
• We are not responsible for market losses
• You invest at your own risk
• Consult financial professionals before investing

10.3 Data Accuracy

• Cryptocurrency prices and data are obtained from third-party sources
• We do not guarantee accuracy, completeness, or timeliness
• Data may be delayed (15 minutes for free users)
• Use data at your own risk
• Verify critical information from official sources

10.4 Service Availability

• The App may be unavailable due to maintenance, technical issues, or third-party service disruptions
• We do not guarantee uninterrupted or error-free operation
• We reserve the right to modify or discontinue features

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

11.1 No Liability for Damages

WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, revenue, or business opportunities
• Loss of data or information
• Investment losses or financial damages
• Damages arising from third-party services
• Damages from unauthorized access or data breaches
• Any damages exceeding the amount you paid for subscriptions in the past 6 months

11.2 Force Majeure

We are not liable for failure to perform due to circumstances beyond our reasonable control, including:

• Natural disasters
• War, terrorism, or civil unrest
• Government actions or regulations
• Internet or telecommunications failures
• Third-party service disruptions

12. Indemnification

You agree to indemnify, defend, and hold harmless Alkashier LTD, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any laws or regulations
• Your violation of third-party rights
• Your investment decisions based on App data
• Unauthorized access to your device or accounts

13. Termination

13.1 Termination by You

You may stop using the App at any time by:

• Uninstalling the App from your device
• Canceling your subscription (if applicable)

13.2 Termination by Us

We may suspend or terminate your access to the App:

• If you violate these Terms
• If we discontinue the App
• For any reason with or without notice
• If required by law or legal process

13.3 Effect of Termination

Upon termination:

• Your license to use the App ends immediately
• You must stop using the App and delete it from your device
• Subscription fees are non-refundable (subject to store policies)

14. Governing Law and Dispute Resolution

For users in Egypt:

• Disputes shall be resolved in the competent courts of Egypt

For international users:

• We will make reasonable efforts to resolve disputes amicably
• If resolution fails, disputes may be subject to arbitration or local courts as applicable

14.3 Dispute Resolution Process

2. Negotiation: We will negotiate in good faith for 30 days
3. Formal Proceedings: If unresolved, pursue legal remedies as provided above

14.4 Class Action Waiver

To the extent permitted by law, you agree to resolve disputes individually and waive the right to participate in class actions or representative proceedings.

15. Changes to Terms

15.1 Right to Modify

We reserve the right to modify these Terms at any time. Changes will be effective when:

• We post updated Terms in the App
• We update the "Last Updated" date
• You continue using the App after changes are posted

15.2 Notification

For material changes, we will provide notice through:

• In-app notification
• Email (if we have your email)
• Prominent display on first launch after update

15.3 Acceptance

Continued use of the App after changes constitutes acceptance of the new Terms. If you do not agree, stop using the App.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Alkashier LTD regarding the App.

16.2 Severability

If any provision is found invalid or unenforceable, the remaining provisions remain in full effect.

16.3 Waiver

Failure to enforce any provision does not constitute a waiver of that provision or any other provision.

16.4 Assignment

You may not assign or transfer these Terms. We may assign these Terms to any affiliated entity or successor.

16.5 No Agency

These Terms do not create any agency, partnership, or joint venture relationship between you and Alkashier LTD.

16.6 Language

These Terms are written in English. Translations may be provided for convenience, but the English version prevails in case of conflict.

16.7 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.
